Contract Type: Minimum term, followed by month to month.

Changes to the Original Scope of Work: If you wish to make “Amendments” “Changes” or “Additions” to the scope of work in this Agreement, we will then issue you a Change Order detailing a new scope of work.

Website Ownership Terms: Cornerstone Web Studio LLC retains ownership of the website outright until you purchase the website through the Buy-Out Option.

(a) Cornerstone employees will be the only admins permitted on the website until the buy-out option is exercised.

(b) Only Cornerstone employees are permitted to make changes to the website that requires administrative access. Examples might include adding plugins, custom coding, etc…

Buy-Out Option: You may purchase the website at any time by paying the Buy-Out Amount found in your Website Agreement and on your Initial Invoice.

Payment Method: One-off design fee with recurring monthly fees

a) on a monthly recurring basis; or
b) upfront for 12 months on an annual recurring basis (“Annual Fee”)

(i) If you choose to pay an Annual Fee then at the end of each 12 Month period, you will automatically renew after every 12 Month period. For each Annual Fee you pay, you will receive a 10% discount on the total amount of 12 monthly recurring payments excluding taxes.

Domain Name Ownership: If we purchase a Domain Name to accompany the site, we will transfer that to your registrar at your request.

Hosting Terms: Basic Hosting Services are provided with our Flex Budget Website.

Website “User” Access Terms: Until a Client purchases their website by paying their Buy-Out amount, Cornerstone will not authorize any outside “Admins” to be added to Flex Budget Websites.

Non-Responsive Agreement: If a client fails to communicate or otherwise becomes unreachable (without prior notice) or is unresponsive for more than twenty (20) consecutive business days during the project, they will be subject to our basic hosting and maintenance fees of $150 per month.

Cancellations: A 30-day Cancellation Request must be received via email. Your Website will remain live until the end of the following month.

(a) At the time of cancelation, you may choose to enact the Buy-Out Option to purchase full ownership of the website and either:

1. Create a new Order for Service for Hosting with Cornerstone Web Studio
2. Transfer the site to an outside Registrar

(b) At the time of cancelation, you may choose not to enact the Buy-Out Option to purchase full ownership of the website, in which case you will no longer be able to access or use these Services and any account that you hold with us may be deactivated or deleted.

1. Cornerstone will not maintain a backup of your website. This means we may not be able to recover your website design in the future.
2. Client agrees not to use the likeness of their Cornerstone Flex/Express website in the development of any future website or marketing effort.
3. Client agrees not to use any stock photos purchased through Cornerstone’s account with Getty Images on any outside marketing effort or future project.
4. Client may copy any contextual content or images they provided to use on any outside marketing effort or future project. However, they are responsible for copying said content before the site expires, which will happen 30 days after their cancellation request is received.

Canceling Hosting Service:

(a) If you cancel your hosting service with Cornerstone, it is your responsibility to migrate your website to your new company’s hosting account; or

(b) You can request Cornerstone assist in migrating your website to a host of your choice for an hourly fee. 

(c) Cornerstone is not liable for the stability, functionality, or design of your website once you leave our hosting service. 

Refunds/Credit: If you have bought this Service and have chosen to pay the Fees on a monthly recurring basis: On any cancellation made part way through a Service Month (except cancellation under paragraph 21(e) of the General Terms) we will give you a pro-rated refund or credit.

(i) If a cancellation is requested during the Design process, refunds or credits will be pro-rated based on the amount of work completed. The pro-rated amount to be refunded or credited is at the sole discretion to Cornerstone Web Studio to calculate based on the degree of project completion.

(ii) If you have chosen to pay an Annual Fee for this service: On cancellation made part way through or at the end of a Service Month (except cancellation under paragraph 21(e) of the General Terms) we will give you a pro-rated refund or credit. Please note that any discount that you received for this Service will be taken out of any pro-rated refund or credit that we give you.

(iii) Please note that if you cancel before the end of your one (1) year signup term, you will have to repay any discount amounts you received for this Service (the “Discount Repayment Amount”). Any pro-rata refund or credit that you are entitled to will be deducted from the Discount Repayment Amount, and you will be billed this amount on your next monthly payment date.
